Terms of service

The rules for using our website and requesting insurance quotes from SunGate Insurance Agency.

These Terms of Service govern your access to and use of this website, our online quote request and contact forms, and the insurance agency services provided by SunGate Insurance Agency (collectively, the "Services"). By using our website, requesting a quote, or contacting us for insurance services, you agree to be bound by these Terms. If you do not agree, please do not use our website or request our Services.

These Terms include important disclosures about our role as an independent insurance agency, the non-binding nature of quotes, and a limitation of liability. Please read sections 3 and 5 carefully.

1. Permitted and prohibited use

Permitted use. You may use our website and contact forms to learn about insurance products, request quotes, ask questions and communicate with us for your own lawful purposes.

Prohibited use. You will not use our website for any unlawful purpose or in violation of these Terms; attempt to gain unauthorized access to our website or customer records; use automated means, such as bots or scrapers, without our written permission; upload malicious code or interfere with our website's operation or security; or provide false or misleading information when requesting a quote or applying for coverage.

2. Intellectual property

Our content. SunGate Insurance Agency owns or licenses all content on our website, including text, images, logos and branding ("Our Content"). You may view and share Our Content for personal, non-commercial purposes, but may not reproduce, modify or use it commercially without our written consent.

Carrier content. Product names, logos and descriptions of insurance carriers referenced on our website belong to those carriers and are used to identify products we may help you obtain. Their appearance does not imply endorsement by us of the carrier, or by the carrier of us, beyond our appointment to represent their products.

3. Our role as an insurance agency; quotes are not coverage

Independent agency. SunGate Insurance Agency is a licensed independent insurance agency. We do not underwrite insurance policies. We help you compare and apply for coverage offered by third-party insurance carriers with which we are appointed, and we may receive commissions or other compensation from those carriers for policies placed through us.
Quotes are non-binding. Any quote, estimate or premium indication provided through our website, by phone or by email is non-binding and does not constitute an offer, application, binder or confirmation of insurance coverage. Coverage takes effect only when the applicable carrier issues a binder or policy and, where required, you have paid any applicable premium.
Accuracy of information. Quotes and coverage decisions are based on the information you provide. You agree to provide complete and accurate information about yourself, your property, vehicles, business or other insured interests. Inaccurate or incomplete information may result in delayed, denied or cancelled coverage, or denial of a claim, by the carrier.
No legal, tax or financial advice. Information provided on our website or by our team is for general informational purposes about insurance products and does not constitute legal, tax or financial advice.
Claims assistance. We may assist you in reporting or navigating a claim as a courtesy, but claims are adjusted, evaluated and paid solely by the applicable insurance carrier in accordance with your policy. We do not guarantee any claim outcome.

4. Fees; no charge for quotes

Quotes. We do not charge a fee for providing a quote or general insurance guidance.
Premiums and fees. Any premiums, fees or other charges associated with a policy are set by the issuing carrier (and, where permitted by Florida law, may include agency fees disclosed to you before you purchase), and are payable according to the terms of your policy or as otherwise agreed in writing.
Refunds. Refunds of premium are governed by the terms of your policy and the issuing carrier's policies, not by SunGate.

5. Limitation of liability and disclaimers

Disclaimer. Our website and Services are provided "as is" for informational and quoting purposes. We do not guarantee that any particular coverage, carrier or premium will be available to you, or that coverage obtained will meet your needs; you are responsible for reviewing your policy documents and confirming that coverage meets your needs.
Limitation of liability. To the maximum extent permitted by law, SunGate is not liable for indirect, incidental or consequential damages arising from your use of our website or Services, or from any act or omission of an insurance carrier, including denial of a claim. Our total liability for any claim relating to our Services will not exceed the amount of commission we received in connection with the policy giving rise to the claim.
Errors and omissions coverage. SunGate Insurance Agency is a licensed Florida insurance agency and maintains errors and omissions insurance. Nothing in this section is intended to limit any claim properly covered under that insurance.
Exceptions. Nothing in this section limits liability where Florida law does not permit such a limit, including for our gross negligence or willful misconduct.

6. Termination

By you. You may stop using our website or ask us to stop contacting you at any time using the contact information below. Ending your use of our website does not affect any insurance policy already in force through a carrier.

By us. We may decline to provide a quote or discontinue assistance if we are unable to verify the information provided, if a carrier declines to offer coverage, or if we reasonably believe use of our website violates these Terms.

7. Dispute resolution; governing law

Informal resolution. Before filing a claim, you and SunGate agree to first try to resolve the dispute informally by contacting us.

Jurisdiction and venue. Any dispute arising from these Terms or our Services that cannot be resolved informally will be brought exclusively in the state or federal courts located in Seminole County, Florida, and you consent to the jurisdiction of those courts. Nothing in this section prevents either party from bringing a claim in small claims court. This section does not apply to disputes about your insurance policy itself, which are governed by the terms of that policy and the issuing carrier's procedures.

Governing law. Florida law governs these Terms, without regard to conflict-of-law rules.

8. Severability and general terms

Severability. If any provision of these Terms is found unenforceable, the rest remain in effect, and the unenforceable provision will be modified to the minimum extent necessary to make it enforceable.
Entire agreement. These Terms, together with our Privacy Policy and any quote, application or policy documents provided to you, are the entire agreement between you and SunGate regarding our website and Services.
Changes to these Terms. We may update these Terms from time to time. Material changes will be reflected by an updated "Effective Date." Continued use of our website or Services after changes take effect constitutes acceptance.
No waiver. Our failure to enforce any provision of these Terms is not a waiver of our right to do so later.
