Privacy policy

How we collect, use, and protect your personal information as a licensed independent insurance agency.

SGI-LEGAL-PRIV-01 · Effective August 10, 2026

1. Scope

SunGate Insurance Agency ("SunGate," "we," "us") respects the privacy of visitors to our website and our clients. This Privacy Policy explains what information we collect, how we use it, and the choices available to you. Because we are a licensed insurance agency, this Policy also describes our practices for nonpublic personal information as addressed under the Gramm-Leach-Bliley Act and Florida insurance privacy law.

This Policy applies to sungateinsurance.com and related properties, our online quote and contact forms, and personal information we collect in connection with auto, home, condo, flood, renters, landlord, boat, classic car, motorcycle, ATV, RV, life, business, workers' compensation, bonds, and other insurance products, and group benefits, that we help arrange through licensed insurance carriers.

2. Information we collect

  • Contact & quote information — name, email, phone, mailing or property address and date of birth, provided by you through our quote and contact forms, by phone or by email, and used to prepare quotes and communicate with you.
  • Application information — driver's license number, vehicle VIN, property details, prior insurance and loss history, business details, and health information for life insurance or group benefits, used to submit applications to carriers and service your policy.
  • Payment information — payment method details and billing address, used to process agency fees where applicable (premiums are generally paid to the carrier).
  • Website usage data — IP address, browser type, pages visited and cookies, collected automatically to operate, secure and improve our website.

3. How we use information

  • To prepare and provide insurance quotes.
  • To submit applications to, and service policies with, insurance carriers on your behalf.
  • To process any agency fees or payments.
  • To communicate with you about quotes, policy renewals and service, with an opt-out available at any time for marketing communications.
  • To assist with claims as a courtesy, coordinating with your carrier.
  • To comply with legal and regulatory obligations, including those under Florida insurance law, and to enforce our policies.
  • We do not sell personal information to third parties for monetary or other valuable consideration, as "sale" is defined under applicable state privacy laws.

4. How we share information

  • Insurance carriers. We share the information necessary to obtain quotes, submit applications and service your policy with the carriers you choose to work with.
  • Consumer reporting agencies. With your authorization where required, we or a carrier may obtain information from consumer reporting agencies (such as motor vehicle records, claims history (CLUE) or credit-based insurance scores) to underwrite or price coverage.
  • Payment processing. Payment details are shared with our payment processor solely to process agency-related transactions.
  • Service providers. We use third-party vendors for hosting, email, agency management systems and analytics, under agreements that limit their use of data to providing services to us.
  • Legal requirements. We may disclose information where required by law, subpoena, regulatory examination, or to protect the rights, property or safety of SunGate, our clients or others.
  • Business transfers. Information may be transferred in connection with a merger, acquisition, financing or sale of assets, subject to standard confidentiality protections.
  • We do not disclose nonpublic personal information about you to nonaffiliated third parties except as permitted or required by the Gramm-Leach-Bliley Act, Florida law and this Policy.

5. Cookies & tracking technologies

Our website may use cookies and similar technologies to remember preferences, measure site performance and analyze usage. Where required by law, we present a cookie consent mechanism allowing visitors to accept or decline non-essential cookies. Visitors may also control cookies through their browser settings.

6. Your privacy rights

Depending on your state of residence (for example, under the Florida Digital Bill of Rights, the California Consumer Privacy Act as amended by the CPRA, or other applicable U.S. state privacy laws), you may have the right to know what personal information we have collected about you and how it has been used and disclosed; to request deletion of your personal information, subject to certain exceptions, including information we must retain for insurance regulatory, claims or recordkeeping purposes; to correct inaccurate personal information; and to opt out of the sale or “sharing” of personal information for cross-context behavioral advertising (noting that SunGate does not sell personal information).

To exercise these rights, contact us using the information below.

7. Data retention

  • Contact & quote information is retained as long as you remain an active or prospective client and thereafter as needed for servicing and legal purposes.
  • Application & policy information is retained for as long as required by Florida insurance recordkeeping requirements and our agency agreements with carriers, generally for the life of the policy plus applicable retention periods thereafter.
  • Payment information is retained as long as necessary to comply with tax and accounting obligations.

8. Security

We maintain administrative, technical and physical safeguards designed to protect personal information from unauthorized access, use or disclosure. No system is completely secure, and we cannot guarantee absolute security.

9. Children's privacy

Our website is not directed to individuals under 18, and we do not knowingly collect personal information from children. Where we help arrange life insurance or benefits naming a minor, information about the minor is collected from a parent or legal guardian.

10. Group benefits and health information

Where we assist an employer with group health or other benefit plans, we may have limited access to enrollment or eligibility information. We handle such information consistent with applicable law, including, where applicable, our obligations as a business associate or agent of a covered group health plan, and we do not use health information for any purpose other than assisting with the placement and servicing of coverage.

11. Changes to this policy

We may update this Privacy Policy from time to time. Material changes will be reflected by an updated "Effective Date" and, where required by law, additional notice will be provided.
